Overview

Over the past 40 years southeastern Virginia, like much of the nation, has seen explosive growth of common interest communities in the form of homeowners associations, condominiums and real estate cooperatives.  Beginning a little over 30 years ago we foresaw a growing need for counsel in this relatively new area of the law.  Community associations are in essence mini-governments which operate under several state statutes as well as the terms of recorded declarations of covenants, bylaws, rules and architectural guidelines.  These covenants and rules are enforceable by an association’s board of directors in the same manner as city or county ordinances are enforced by a City Council or County Board of Supervisors.  Over the years the firm has come to represent hundreds of associations which require a variety of legal services such as interpretation and enforcement of covenants,  drafting revisions to outdated documents, providing needed documents for voting on new board members or special assessments, and keeping the boards aware of changes in the statutes which occur each year.  The Community Association Law Team at Inman & Strickler is comprised of five lawyers who specialize in this area of law.  The Team provides periodic posting of articles via our web site www.vahoalaw.com and conducts educational sessions for boards of directors. 

Problems And Implications

In order to maintain our expertise and provide the most informed advice, we are active members of the local chapter of a national organization – the Community Associations Institute (CAI). The local chapter (SEVA-CAI) serves all of southeastern Virginia from Williamsburg to Isle of Wight County, Greater Hampton Roads and the Eastern Shore. Members of SEVA-CAI consist of community associations, association management companies, and providers of a variety of services required by associations. Through SEVA-CAI we provide frequent seminars on special topics of interest to association managers, board members and residents.

Our Team members bring a broad range of experience to the specialty practice of Community Association law including business law, real estate law, municipal law and litigation experience in all of these areas.  Our team also possesses expertise with the Virginia Condominium Act, the Property Owners Association Act, the Timeshare Act and the Real Estate Co-0perative Act as well as familiarity with the Fair Housing Act and the Americans with Disabilities Act, which impact Associations regularly.
